Oregon IAR CE: returning after a licensing gap
Oregon’s IAR CE rule took effect January 1, 2023. Returning after a licensing gap requires a different review from simply selecting this year’s twelve credits.
Who is covered by Oregon’s CE rule?
OAR 441-175-0195 applies to IARs licensed or required to be licensed under ORS 59.175. It specifies six regulatory and ethics credits, including at least three ethics hours, and six Products and Practice credits per reporting period. Ask your firm to confirm applicability and the first reporting year from your individual history.
What happens to intervening unlicensed periods?
Oregon’s rule addresses CE for periods between becoming unlicensed and applying again. It provides an alternative when the applicant passes the examination or receives the examination waiver specified in OAR 441-175-0120(6). The regulator must determine which route applies; neither a gap’s length nor a course purchase alone establishes re-registration eligibility.
Check recognition, waivers and reporting separately
The rule allows conditional FINRA Products and Practice recognition, qualifying credential CE and sufficiently stringent home-state compliance. It also permits the director to waive requirements upon a finding of undue hardship. Do not treat these provisions as self-executing exemptions. Excess credits do not carry forward, and the IAR remains responsible for ensuring the provider reports completion.
Planning example: return to practice after a break
Fictional planning example. An adviser seeks to return to Oregon practice after an unlicensed interval. Before buying courses, the adviser prepares a chronology of license termination, intervening years, prior exams and recorded CE. The firm asks the regulator how the re-entry and examination provisions apply. Only the confirmed reporting-year gaps become the course plan.
The worksheet keeps registration eligibility, exam eligibility, renewal payment and learning requirements in separate rows. Attach references to supporting records, not client information. If a determination is still outstanding, label it as an open question rather than an assumed waiver.
Select courses after the re-entry route is clear
Use FinPro balances and prior Course IDs to check the confirmed years and categories. Read the course descriptions and samples for learning fit. Allow for the current reporting and processing schedule; completing a purchase does not restore a license or guarantee accepted credit.
Quick answers
Do unlicensed years matter when returning to Oregon?
They can. OAR 441-175-0195 addresses intervening reporting periods and includes examination and examination-waiver qualifications. Confirm the applicable route with the regulator.
Does Oregon automatically grant a hardship waiver?
No. The rule permits the director to grant a waiver upon finding undue hardship; the applicant cannot assume the determination.
Can I carry excess Oregon CE credits into another year?
No. The rule prohibits carrying forward excess credits.
Does course enrollment restore an Oregon license?
No. Registration eligibility, course completion, provider reporting and accepted credit are separate matters.
